European Climate Law Poses Problems for U.S. Airlines, Policymakers

In two very different ways on Tuesday, Washington will seek to solve a climate-change and sovereign-law conundrum created by its usual European allies across the Atlantic.

The Senate Commerce Committee is scheduled to vote on Tuesday afternoon on bipartisan legislation that would make it illegal for U.S. airlines to comply with a European Union requirement that all airlines flying in or out of Europe pay for the greenhouse-gas emissions that come from those flights. In effect, airlines would be forced to calculate all the carbon-dioxide emissions emanating from their European flights and buy credits for the emissions on the EU?s cap-and-trade exchange.

According to the EU law, which went into effect at the beginning of this year but won?t substantively affect airlines until next May, airlines would have to account for greenhouse-gas emissions on their entire flights, and not just the portions in European air space.

Also on Tuesday, the State and Transportation departments will begin two days of meetings with 16 other non-EU nations to try to find a global substitution to the EU law. Most countries outside the European Union, including the United States, oppose the EU law based on foreign-policy and legal grounds unrelated to global warming.

?The unilateral imposition of the [European cap-and-trade law] is creating huge antagonism all around the world,? said a senior State Department official during a background briefing on Monday. ?We would say it?s the wrong way to pursue the right objective.? We endorse the policy of reducing emissions.?

The Obama administration is trying to walk a fine line between opposing the EU law and staying clear of congressional efforts to make it illegal to comply. It has made clear that it does not support Senate legislation mirroring a measure that passed the House last year that is expected to be voted by the Commerce Committee on Tuesday.

The bill, sponsored by Senate Republican Conference Chairman John Thune of South Dakota and Democratic Sen. Claire McCaskill?of Missouri,?is not expected to get a full vote in the Senate. But if it passes the Commerce Committee ? which is possible ? it could send a strong rebuke to the EU about its emissions law as it pertains to the United States. Democrats voting against it will likely base their opposition on foreign-policy grounds and de-emphasize the impact on global warming.

Aircraft are believed to contribute a scant 3 percent of greenhouse-gas emissions worldwide. But the debate over the EU law epitomizes the repercussions individual countries face amid the continual failure of climate negotiators to reach a global agreement to address climate change.

Meanwhile, the broader Senate remains fixated on a more fundamental element of climate change: The science.

In a floor speech on Monday, Sen. Bernie Sanders, I-Vt., lambasted Senate Environment and Public Works ranking member James Inhofe, R-Okla., for his position denying that global warming exists. Inhofe took to the floor after Sanders to defend his position.

This back-and-forth will take center stage again at a Wednesday hearing of the Senate Environment and Public Works Committee on climate-change science.

New Zealand city aims for 'college campus' rebuild

WELLINGTON, New Zealand (AP) ? A convention center, sports stadium and performing arts complex are among the big projects planned for a new-look downtown Christchurch after the New Zealand city was reduced to rubble by an earthquake last year.

Essentially given a blank slate, government planners on Monday unveiled a blueprint for the city that replaces office towers with green spaces, urban apartments and innovation "hubs" they say will give the city the feel of a college campus. Under the plan, the city will be smaller, the buildings lower in height and constructed to higher earthquake standards.

The plan has been eagerly awaited. It has been nearly 18 months since the magnitude-6.1 quake struck, killing 185 people and irreparably damaging 1,400 downtown buildings including the century-old Anglican cathedral in the city center.

"It will be safe, modern, green and will leave a legacy that makes Christchurch one of the best places in the world to live and work for many generations to come," Christchurch Mayor Bob Parker said in a statement.

Many residents have become frustrated at the slow pace of recovery in Christchurch. Hundreds of substantial aftershocks have hampered progress and made insurers skittish, while government and city officials, including Mayor Parker, have been accused of dithering and bickering. Even before the plan was released, some wondered if they would end up footing a chunk of the bill through rate hikes.

Yet for many, the plan is a welcome step forward. Some see it as a unique chance to correct problems in the city, such as an excess of older-style office space that was evident even before the earthquake. The plan also comes as the aftershocks appear to be finally abating.

Government officials have not yet identified an overall cost for the rebuild or specific funding sources for all the new projects. Nick Bryant, a spokesman for earthquake recovery minister Gerry Brownlee, said Monday that the funding will come from a variety of sources, including local councils, private investors, insurance payouts and from the central government, which has so far set aside 5.5 billion New Zealand dollars ($4.4 billion) for the recovery efforts.

Under the plan, the city would be bordered with green spaces and the overall design would give more emphasis to the winding Avon River. An earthquake memorial would be given prominence, as would a Maori cultural center. The central city square would be divided into a number of smaller public gathering spots.

The city would be broken into a series of hubs featuring related activities. For instance, there would be a health precinct anchored by a hospital, a justice precinct with courts and a police station, and a retail precinct with stores.

The plan identifies sites for big infrastructure projects including a prominent library and a convention center with the capacity to hold 2,000 people that would overlook the river. There would also be a covered sports stadium seating up to 35,000 people built in the city's southeast and an indoor aquatic and recreation center built in the southwest.

In a release, New Zealand Prime Minister John Key, who grew up in Christchurch, said it was important to identify sites for the major new projects so that private developers could begin planning hotels, restaurants and stores to complement them.

"I am delighted to see this plan for new development and to know that construction will soon be underway to rebuild my old hometown," he said.

All I can say - I AGREE!?

The decision to have children young ( and add to it the fact of not being sure if marriage and family were in the plans at all for the next decade if not longer) was a bit intimidating. Scary sometimes. The typical suggestion given to me was " just wait... not now... you are still young".?

Yet.

Having children YOUNG is the best thing - I believe - one can do to be a successful dancer.?

It is true that you need to want both. It is also true that it is a 24 hour job, sometimes feels like 30 hour job in a 24 hour time period. ( but then when ballet is not? I remember dreaming about what I do and working on turn out while eating dinner long before I had children. You just never stop )?

?But it is the best decision I've ever made.?

I watched dancers that perfected their careers without families. I watched dancers that perfected their careers while juggling motherhood. Both can be done.?

I found that going through the motions of motherhood opens a channel that one did not know existed. It is difficult to describe in words. There aren't any.?

It is also a fact that daring comes with younger age.

Having gone through the experience of motherhood at young age - in my mid 20s was when I had my first child -? I am not sure I would repeat the same a decade later. As I grow older , I am not sure I grow wiser, but I do know that my fears of "what if" grow at a fast speed. I can see - completely -? how , when talking to many dancers that are my age now - they are fearful of what pregnancy may bring, what it can do and what it can ruin for them. Being in your 30s is a wonderful time - so far best ever , as you lived long enough to have enough achievements to look at - but at the same time there are plentiful of opportunities to not want to put your life on pause. I wouldn't want to, had I not known different. Had I not known that you don't have to.?

There are many things I could talk about forever. And it would take, probably, a book to describe all my thoughts of going through experience of motherhood while dancing professionally...With four children... ( i can't believe it still. Four? from ME?! I must be crazy. Except that I am SO. HAPPY)?

So, here I'd like to summarize to this:

To each its own time. There is no right or wrong to when one needs - if even so - to have a marriage and/or a family. But if there is a desire to... A longing in the heart, a dream...?

Then do NOT wait. Go for it. You will be happy that you did. There are no words to describe the happiness of motherhood. And there are no words to describe the feeling when little warm and squishy hands give you flowers and tightly hug your neck after the concert. No words to describe the extra boost of energy you get when you think of those warm cheeks and happy eyes that will greet you when you are done. No words to describe what it can compare to , because it can't.

It's worth the double work hours.
Every minute of it.

NEW YORK (AP) ? New York Knicks point guard Jason Kidd was arrested on a drunken-driving charge after police said he crashed his SUV into a telephone pole in the Hamptons on Sunday, days after signing with the Knicks.

Treated at a hospital for minor injuries after the crash, Kidd was arraigned on a misdemeanor driving-while-intoxicated charge and released without bail, Southampton Town police said.

Kidd's agent didn't immediately respond to phone or email messages. The Knicks, who signed the 10-time All-Star in free agency this week, had no immediate comment.

Kidd, 39, was alone in the 2010 Cadillac Escalade when it hit a pole and veered into the woods around 2 a.m. in Water Mill, police said. Water Mill is a serene, mainly residential community east of Southampton Village.

Kidd's next court date wasn't immediate available. The DWI charge carries the potential for up to a year in jail.

The Knicks signed Kidd away from the Dallas Mavericks this week in a deal that will pay him about $3 million a year. Kidd had played in New Jersey, leading the Nets to two NBA Finals appearances, before being traded to Dallas and remains fond of the New York City area, where his children continued to live.

The two-time Olympic gold medalist has been in trouble with the law before. While playing with Phoenix in 2001, he was arrested on a domestic violence charge, acknowledging that he struck his former wife.

Kidd is second on the NBA's career list in assists and steals. The Knicks believe Kidd, who helped the Mavericks win the 2011 NBA championship, would be a good mentor to point guard Jeremy Lin if the team opts to keep him.

The Bain drain: Is Romney repeating his mistakes?

Mitt Romney would later describe it as one of his biggest regrets about his first run for public office.

In 1994, Romney was a virtual unknown running to unseat Ted Kennedy as U.S. senator from Massachusetts. He campaigned on his business record as a turnaround artist at Bain Capital.?But Democrats turned Romney's Bain record against him, casting him as a cold-blooded capitalist who put profits before workers.

The Democratic argument was illustrated by a strike at the Ampad paper plant in Marion, Ind., which had recently been acquired by Bain. The firm had fired most of the plant's employees, offering to rehire them back for reduced wages and benefits. Romney, who was on leave from Bain at the time because of the campaign, had no direct role in the Ampad dispute, but Kennedy seized upon the drama inside the company. Kennedy even appeared with some of Ampad's workers, who traveled to Massachusetts to protest Romney's claim of being a job creator at Bain.

Romney distanced himself from Ampad and other Bain-controlled companies by insisting he had no day-to-day role in what Bain was doing.?Yet in an interview with the Boston Globe a few weeks after his loss in November 1994, Romney admitted that he was haunted by his failure to respond to the attacks on his record at Bain. He often woke up at night thinking about his missed opportunities in the campaign, he said.

And he said his biggest mistake was failing to quickly respond to Kennedy's attacks over Ampad.

"It left in the minds of voters I was a bad guy, a corporate downsizer and raider, and I should have responded more vehemently," Romney told the Globe. "I am a big boy and I know how politics is played. But I thought it would play more to the facts."

Eighteen years later, President Barack Obama and his Democratic allies have spent tens of millions of dollars on television ads casting Romney as a dangerous corporate raider who doesn't care about the middle class. In recent days, the Obama campaign has expanded that attack, accusing Romney of being secretive about his estimated $250 million personal fortune, much of which he accrued during his time at Bain. It's all a part of a larger effort by Democrats to cast Romney as a rich guy out of touch with the Americans who are struggling under the bad economy?a strategy that could help Obama deflect criticism that he hasn't done enough to turn the economy around.

Romney and his staff have been slow to push back on the Democratic attacks, which has prompted much hand-wringing among Republicans who worry that the Obama campaign is going to cement an impression of Romney in voters' minds before the party's presumptive presidential nominee can define himself.

"I am not sure what they are thinking," a Republican strategist, who declined to be named because he is advising the Romney campaign, told Yahoo News. "Yes, you don't want to be baited into answering every charge. But you also don't want to allow your opponent to define you before an American public that really doesn't know a lot about you yet."

On Friday, the Romney campaign made some changes. It hired Danny Diaz, a GOP operative who previously worked for John McCain and the Republican National Committee, to handle rapid response with the news media.?And the candidate agreed to sit down for interviews with five TV networks?ABC, CBS, CNN, Fox News and NBC?in what is presumed to be a part of the campaign's pushback against the Bain attacks.

So far, Romney has firmly sided with his senior advisers, who have repeatedly argued that the road to victory in November is to keep their focus singularly on Obama's handling of the economy, which they believe will be the No. 1 issue at the polls in November.

Romney dismissed the concerns that he's not being aggressive enough in his responses to Democratic attacks, in an interview Wednesday with Neil Cavuto of Fox News.

"I respond to the attacks that come, but they say in politics if you are responding, you are losing. I think the better course for our campaign is to respond to the attacks as being completely off base," Romney said. "People are tired of this petty attack that comes from politicians, and they want to see someone who talks about the issues they care about."

But there is a danger in ignoring the attacks, as at least one of Romney's close allies can attest. In 2010, Tom Foley, a former U.S ambassador to Ireland,?came under intense attack for his career as a venture capitalist during his bid to win the Republican nomination for governor in Connecticut. Democrats later revived the attacks during the general election, linking Foley to a Georgia textile plant that was forced into bankruptcy and shuttered.?Foley countered that the plant's closing happened years after his firm had sold the company, and he recorded?a TV ad in which he spoke directly to the camera and disputed his Democratic opponent's claims.

The ad was cut by Russ Schriefer, a longtime Republican strategist who was advising Foley's campaign and is now one of Romney's chief political advisers. Foley came up short in the race?a loss he credits in part to the last-minute attacks on his business career.

"If we'd had two or three more days, we probably could have won," Foley told Yahoo News.

Foley told Yahoo News that he sees "eerie" similarities between the attacks lobbed against his campaign and those being targeted at Romney. He told Yahoo News he wouldn't "second guess" the Romney strategy,?but he said Republicans don't want to see Romney being "roughed up."

"Your own supporters want you to counterattack," Foley said. "They want to be comforted that you are doing the right thing."

The Romney campaign signaled a more aggressive tactic toward the Obama campaign on Thursday, unveiling a new TV ad airing in key swing states that accuses the president of lying about Romney's record. That was followed up on Friday by a second ad?that uses?Obama's own words to decry "scare tactics" in campaigns. They also unveiled a new page on the Romney website, calling out Obama for his distortions.

But at the same time, the Romney campaign appeared to be caught flat-footed by a story in the Boston Globe that suggested Romney may have worked at Bain Capital longer than he previously suggested. Although the campaign issued statements calling the story inaccurate, the story itself noted that Romney officials would not be quoted on the record responding to the Globe's questions. The move appeared to reflect a Romney strategy that was frequently exercised in during the primaries, in which the campaign tried to kill news stories by simply not responding to them?a tactic that is unlikely to be as successful heading into the heat of the general election.

The Obama campaign immediately latched on to the Globe report, with Stephanie Cutter, Obama's deputy campaign manager, going so far as to accuse Romney of potentially committing a felony by misstating his role at Bain Capital.

Cutter's quote instantly made headlines, but it took nearly four hours for the Romney campaign to formally respond by?issuing a statement from Romney campaign manager Matt Rhoades trashing her comment as a "new low" in the campaign.

Romney aides note, accurately, that most national polls still find the race a statistical tie between Obama and Romney, which they argue is evidence that their boss?has not been hurt by Obama's attacks on Bain and Romney's personal finances.

But polls also find that most voters are still learning about Romney?and still deciding what they think about his Bain resume and Obama's claims that Romney outsourced jobs overseas. An ABC News/Washington Post poll released this week found that 40 percent of those polled believe Romney "cut jobs" while at Bain?a slight uptick from earlier this year?while 36 percent believe he did more to "create jobs."

A senior Romney adviser told Yahoo News that the attacks don't matter to voters?and won't impact the vote in November. "Voters don't care," the adviser, who declined to be named while discussing strategy, said. "People care about whether they can pay their bills and whether they have a job. And Obama has failed to make that better. That's what's really going to affect this race."

FIFA names Havelange, Teixeira in kickbacks case

GENEVA (AP) ? Former FIFA president Joao Havelange and one-time Brazilian soccer leader Ricardo Teixeira received millions of dollars in a World Cup kickbacks scandal, soccer's world governing body confirmed on Wednesday.

FIFA finally published a Swiss court dossier which detailed that Teixeira received at $13 million from 1992-97 in payments from World Cup marketing partner ISL. The Swiss-based agency's collapse into bankruptcy in 2001 sparked a criminal probe and exposed the routine practice of buying influence from top sports officials.

The 41-page document showed Havelange received a payment of about $1 million in 1997, one year before he was succeeded as FIFA president by Sepp Blatter.

Payments "attributed" to accounts connected to the two Brazilians totaled almost $22 million from 1992-2000.

The scale of kickbacks tied to World Cup broadcasting and marketing deals was revealed in a report by a prosecutor in the Swiss canton (state) of Zug who investigated Havelange and Teixeira for "embezzlement, or alternatively disloyal management."

The document had been blocked from publication since June 2010, soon after prosecutors, FIFA and two of the most powerful men in world soccer reached a settlement deal to close the criminal investigation.

FIFA, Havelange and Teixeira repaid $6.1 million to end prosecutor Thomas Hildbrand's probe on condition that their identities remain secret.

Teixeira, who repaid $2.5 million, denied criminal conduct. Havelange, who paid $500,000, "did not comment on the accusation of criminal conduct," the report said.

Before agreeing to repay $2.5 million, FIFA made its "consent conditional" upon dropping proceedings against its former president and then-serving member of its executive committee, the report showed.

FIFA released the document hours after Switzerland's Supreme Court threw out an appeal by Havelange and Teixeira to suppress the dossier, and announced its ruling that media organizations should receive details of the ISL case.

"FIFA is pleased that the ISL non-prosecution order can now be made public," soccer's world governing body said in a statement.

Still, Hildbrand's report criticized FIFA as "a deficient organization in its enterprise" prior to ISL's collapse.

Havelange and his former son-in-law Teixeira "unlawfully used assets entrusted to (them) for (their) own enrichment several times. FIFA suffered an equivalent loss."

After helping broker the anonymity deal, FIFA was also a party to earlier appeals to block publication until dropping out of the case last December.

Calls Wednesday to the Brazilian Football Confederation, which Teixeira headed for 23 years until March, rang unanswered.

Blatter ? who was Havelange's secretary general for 17 years ? said in October that he wanted to release the ISL dossier despite his organization seeking to deny reporters access to its contents at the same time.

Though Blatter has not been accused of accepting unethical payments, the ISL affair has clouded much of his 14-year FIFA presidency. Seeking closure has become central in his promised mission to improve FIFA's image and governance.

Blatter was not specifically named in the redacted document, though he appeared to be represented several times as "P1".

Hildbrand's report said it was "not questioned" that FIFA personnel knew about kickback payments.

The prosecutor wrote of FIFA witnesses confirming that a $1 million payment to Havelange "was mistakenly transferred to a FIFA account.

"Not only the CFO (chief financial officer) had knowledge of this, but also, among others, P1 would also have known about it," the report said.

Havelange was FIFA president for 24 years and remains honorary president. The 96-year-old Brazilian has been treated extensively in a Rio de Janeiro hospital this year for a bacterial infection.

He resigned his 48-year IOC membership in December, citing health reasons, days before the Olympic body was due to sanction him following its own investigation into wrongdoing connected to ISL.

Teixeira resigned this year as head of Brazil's soccer federation and the 2014 World Cup organizing committee, and gave up his FIFA executive committee seat after 18 years, citing unspecified health and personal reasons.

The ISL scandal stemmed from alleged payments of tens of millions of dollars to sports officials made by the agency before its collapse with debts of $300 million. Commercial bribery was not a crime in Switzerland at the time.

ISL was created in the 1970s and helped fuel the boom in sports marketing, while also working closely with the International Olympic Committee.

Hildbrand's report said the agency funneled money through Liechtenstein to pay commissions to officials "favored in order to promote sports policies and economic goals."

Six former ISL executives stood trial in 2008 and were cleared of charges relating to fraud.

In court evidence, FIFA executive committee member Nicolas Leoz, a Paraguayan who still heads the South American soccer confederation, was identified for receiving two ISL payments totaling $130,000 in 2000.

Steve Sultanoff has a passion for a bargain, but he doesn?t feed his need for retail triumph by hitting the mall. Instead, like millions around the world, the Irvine, Calif., resident turns to Internet auction giant eBay.

Many discover what they?re looking for on the site of the auction giant and field innovator, which was founded in 1995. Sultanoff, who says he?s personally won about 1,200 auctions, has bought everything there from a microwave part to impossible-to-find tickets to baseball legend Cal Ripkin?s final game.

?The Ripkin tickets are what hooked me,? says Sultanoff. How eBay and Similar Auction Sites Work

The basic online auction, like the ones held on eBay, works like those in real life: Bidders increase the amount they will pay for the item until time runs out and the top bidder wins. Sometimes an auction has what?s known as a ?reserve? or the lowest price the item?s owner will accept for the item, and sometimes it doesn?t. Items that fail to meet the reserve bid go unsold.

When an item is successfully purchased at auction, the bidder pays the bid price via credit or debit card or through a bank account ? or PayPal, which accepts all three. Customers use a cumulative ratings system known as ?feedback? to grade sellers.

Although it isn?t common, it?s possible to manipulate the feedback through selling a large number of penny items, such as coupons, in order to compile a good reputation. Sultanoff recommends reviewing a seller?s feedback in depth before purchasing an item.

?But really, there are very few scammers on eBay these days,? he says. Penny Auctions

Although the best known of Internet auctions, eBay isn?t the only game in town. Penny auctions have flooded the Internet, causing more than a few eyebrows to rise in response.

A penny auction generally offers a valuable item with an opening bid of 1 cent. The bid rises in penny increments, but when the bid hits the last few seconds, the clock resets with each additional bid. And while items sell for what seem like ridiculously low prices (think of an iPad for $ 11), this time there really is a catch.

In most penny auctions, bidders purchase the points they use in advance, much like a gambler buys chips. The points aren?t cheap ? they?re often $ 1 apiece ? and each point represents a penny bid.

Bids aren?t retractable ? which means if you bid, even if you don?t win the item, you still forfeit the points you have banked. That means if someone who bids 10 times on the iPad loses, he forfeits $ 10 worth of points. And if the iPad sells for $ 11, then the real selling price of that particular piece of electronics isn?t $ 11, but $ 1,100 ? significantly more than the retail cost of the item.

Although penny auctions aren?t regulated, many are concerned they?re really a form of gambling. Barry Shore, who cofounded the penny-auction site YouNeverLose, is among critics of the basic model. Although he defends the industry in general, he admits not all are on the up and up.

?Hundreds of sites go out of business very quickly; they attract lots of people, then take the money and don?t pay out,? says Shore.

There are several types of penny auctions, but the two most common are the forward auction where the selling price goes up one cent for each bid, and a reverse auction where the item starts at a certain price and moves downward until someone?s willing to pay that price.

Shore says YouNeverLose differs from some penny auctions because bidders don?t buy the points outright. They receive points as a bonus when they purchase gift cards for face value. For instance, a buyer who purchases a Trader Joe?s gift card for $ 50 would receive 50 bidding points.

The buyer can then bid on the gift cards offered for sale on Shore?s site, such as a $ 25 Starbucks card, which might go for 82 cents, for example. The winning bidder in this case bid 30 times and pays 30 points for the card. The other 52 cents or points come from the losing bidders, who have to pony up the points whether they win or not.

?I make my money by negotiating a discount with the gift card retailers,? says Shore on how he turns a profit. But he cautions that it?s nearly impossible to distinguish between a legitimate operation and one that?s not. He says only auction sites that guarantee a dollar-for-dollar return are worth taking a second look. For example: A $ 50 investment yields a $ 50 gift card and 50 bidding points.

?You?re risking money when you play on any penny-auction site. ? If a penny-auction site involves risking your money, don?t do it,? he says. The Big Boys

Paul Minshull has a theory as to why online auctions appeal so much to consumers. ?I think it?s the transparency, that you can do it from home,? says the chief operating officer of one of the top auction houses in the country, Heritage Auctions.

Although Heritage Auctions is located in Dallas, it operates worldwide and many of its auctions make the news. The company offers high-end collectibles such as fine wine and art. This is where, for the right price, you could find a Monet painting or rare bottle of wine up for grabs.

But, says Minshull, large consignment auction houses like Heritage aren?t outside the reach of the average guy. ?We carry many interesting items that sell for less than $ 100,? he says.

Unlike auctions that are mostly owner-driven, Heritage acts as a go-between and authenticator, which can be reassuring when determining the value or provenance of an item. Minshull offers the tale of one potential customer who brought in a baseball he believed to be signed by baseball great Joe DiMaggio. Heritage?s expert told him it wasn?t real.

?The guy said it was real because he was there when DiMaggio gave it to him, and our sports expert asked him if he actually saw DiMaggio sign it,? Minshull says. The man admitted he had not, that DiMaggio had reached into a bag and pulled out a signed ball.

That, says Minshull, is what is known as a ?clubhouse ball,? a time-honored sports tradition.

?The players pay the clubhouse boy to sign (baseballs) for them,? says Minshull.

Still, the authenticator role can work in the seller?s favor, as a comic book collector?s widow discovered. She almost sold her late husband?s collection to a dealer for $ 25,000 simply so she could close out the storage unit where the comic books were kept. Instead, she struck pay dirt, making $ 3 million at a Heritage auction.

3 Armstrong associates get lifetime USADA bans

AUSTIN, Texas (AP) ? With Lance Armstrong digging in for a legal fight, the U.S. Anti-Doping Agency issued lifetime sports bans Tuesday to three former staff members and consultants on the cyclist's winning Tour de France teams for drug violations.

Luis Garcia del Moral was a team doctor; Michele Ferrari was a consulting doctor; and Jose "Pepe" Marti (team trainer) worked for Armstrong's U.S. Postal Service and Discovery Channel squads. All had been accused by USADA of participating in a vast doping conspiracy on those teams during part or all of Armstrong's seven Tour victories from 1999-2005.

Armstrong also has been charged and has declared his innocence.

Several hours after USADA announced its sanctions against the others, Armstrong's attorneys refiled a lawsuit asking a federal judge in Austin to prevent the case against from going forward.

U.S. District Judge Sam Sparks had thrown out Armstrong's initial 80-page complaint Monday, but invited him to submit a new one that was shorter, more to the point and less about his career and personal battles with anti-doping officials.

Armstrong's attorneys refiled a 25-page suit arguing that USADA violates athletes' constitutional rights, that the agency doesn't have the jurisdiction to bring the charges and that it may have violated federal law in its investigation.

Armstrong wants the court to rule by Saturday, his deadline to either accept USADA's charges and sanctions or send his case to arbitration.

An Armstrong spokesman declined immediate comment on the USADA bans issued Tuesday.

Under USADA rules, Moral, Marti and Ferrari had until Monday to challenge the allegations against them in arbitration or ask for a five-day extension. If they did not respond, USADA could impose sanctions.

Although none lives in the United States, USADA says the ban blocks them from participating in any sport that falls under the World Anti-Doping Agency code.

"The respondents chose not to waste resources by moving forward with the arbitration process, which would only reveal what they already know to be the truth of their doping activity," said Travis Tygart, chief executive of USADA.

There's been no indication from USADA that any of the three men ? who each received the agency's maximum punishment ? is cooperating with investigators.

Armstrong was granted his extension while he files his court case. Also charged and granted an extension was Armstrong's former team manager, Johan Bruyneel.

Another team doctor, Pedro Celaya, also has been charged and faced the same Monday deadline. A USADA spokeswoman declined to say if Celaya asked for an extension or for his case to go to arbitration.

USADA filed the charges against Armstrong and the others in June, laying out what it calls a vast doping conspiracy on Armstrong's teams when he was winning the Tour de France from 1999-2005.

Moral, who lives in Spain, was the team physician from 1999-2003. According to USADA, he helped riders use banned blood transfusion techniques to help boost endurance. He also helped them use banned performance-enhancing drugs including the blood-booster EPO and steroids.

Moral could not immediately be reached for comment by telephone or email.

Ferrari, who lives in Italy, was a consulting doctor for Armstrong and the U.S. Postal Service and Discovery Channel teams from 1999-2006, according to USADA. USADA said Ferrari developed a special mixture of testosterone and olive oil to be placed under the tongue to help riders recover from races and training. He also helped advised riders how to use EPO and avoid detection.

Ferrari's lawyer could not be immediately reached for comment and there was no answer at Ferrari's home. The doctor already was banned for life by the Italian cycling federation in 2002.

Marti, of Spain, who worked for the U.S. Postal Service, Discovery from 1999-2007 and then Astana, helped deliver performance-enhancing drugs to riders in Europe and helped with injections, USADA said.

"Permanently banning these individuals from sport is a powerful statement that protects the current and next generation of athletes from their influence, and preserves the integrity of future competition," Tygart said.
